Terms of Service

These Terms are between the person or organisation using Setfolios and Axel Arturo Avila Ortiz. By creating an account, purchasing a service, or continuing to use the platform, you agree to these Terms, the Privacy Notice, Community Guidelines, and any product-specific terms shown at checkout. If you use Setfolios for an organisation, you confirm that you have authority to bind it.

You must be at least 18 years old and legally able to enter this agreement. Provide accurate information, keep credentials confidential, maintain a working email address, and promptly update important account details. You are responsible for activity carried out through your account unless you promptly report unauthorised access. One person or organisation must not use accounts to evade restrictions or allowances.

Setfolios provides online tools for professional discovery, communication, and project collaboration. Unless a specific Setfolios service expressly states otherwise, Setfolios does not recruit, select, hire, employ, engage, supervise, direct, control, or pay any member for project work. It is not an employer, casting agency, talent agent, production company, payroll provider, union, insurer, escrow service, or party to an agreement between members. No employment, agency, partnership, joint venture, fiduciary, or representative relationship with Setfolios is created by using the platform. A project listing, application, invitation, message, search result, badge, or other platform activity is not a Setfolios endorsement, recommendation, verification, or guarantee of a member, project, or result.

Project owners decide independently whom to contact and engage, and creatives decide independently whether to accept an opportunity. Before working together, members must make their own checks appropriate to the project, including identity, portfolio, qualifications, references, authority, right to work, suitability, working conditions, safety, and any other information important to the decision. Setfolios does not conduct criminal, identity, qualification, or reference checks unless a feature clearly says that a particular check was completed. Members must enter their own agreement covering matters such as scope, deliverables, deadlines, compensation, payment timing, expenses, cancellation, intellectual-property and usage rights, credit, confidentiality, working conditions, insurance, permits, tax, and employment or contractor classification.

The member engaging a creative is responsible for the engagement decision, project instructions, and acceptance of the work. The member providing services is responsible for performing the agreed work professionally, lawfully, safely, and on time. The members—not Setfolios—are responsible for the quality, suitability, accuracy, legality, safety, delivery, payment, and outcome of services agreed between them, and for their own acts and omissions. A dispute about those services or their separate agreement is between the participating members. Setfolios may receive reports and moderate accounts or content under these Terms, but doing so does not make Setfolios a party to the engagement or a guarantor of the work or payment. This section does not limit Setfolios' responsibility for operating its own services or any responsibility that applicable law does not allow it to exclude.

Members may publish professional information through a setfolio and use it to discover or be discovered for projects. Project owners must describe roles, dates, location, compensation, expenses, usage expectations, sensitive scenes, and relevant working conditions honestly. An application, shortlist, invitation, acceptance, or team membership does not guarantee work, payment, credit, immigration status, or any other outcome. Before posting, the project owner must confirm compliance with the Community Guidelines. Setfolios may block prohibited content or hold a sensitive listing for safeguarding review. Payment does not guarantee publication of content that violates these Terms. Members must not request unlawful work, discriminatory criteria, unsafe activity, deceptive auditions, or payment from applicants as a condition of consideration.

Messaging is tied to eligible project relationships. Project owners may contact applicants during review. Accepted applicants and invitees may join project workspaces and team conversations. Do not use messages for spam, harassment, coercion, unlawful discrimination, scams, credential collection, or unrelated commercial promotion. Members are responsible for preserving any records they need outside Setfolios.

Current prices, allowances, renewal periods, and included project-post credits are shown on the Pricing and Billing pages. An authorised payment provider processes payments. Taxes may be added where Setfolios is registered and required to collect them. Subscriptions renew until cancelled through the billing portal. Cancellation stops future renewal but normally leaves access active until the end of the paid period. Credits and weekly allowances have no cash value, cannot be transferred, and may be subject to the plan rules displayed when purchased. Promotional offers may be limited, reviewed, changed, or withdrawn for future posts.

Nothing in these Terms removes mandatory consumer rights. Consumers in the EU, EEA, and UK may have a statutory withdrawal period for distance contracts. When a consumer expressly requests immediate performance, they may owe a proportionate amount for service already supplied, and the right may end after full performance where the legal conditions are met. US and Mexican consumers retain any non-waivable cancellation, disclosure, charge-dispute, and service-remedy rights that apply to them. The Refund and Withdrawal Policy provides the operational process.

You retain ownership of content you submit. You grant Setfolios a worldwide, non-exclusive, royalty-free licence to host, store, reproduce, format, display, transmit, and make that content available only as needed to operate, secure, promote, and improve the platform and to display public setfolios, projects, and credited participation. The licence ends when content is deleted, subject to reasonable technical backups, legal retention, content shared with other members, and material already used with permission. You confirm that you have the rights and permissions needed for every image, link, name, credit, brief, message, and other item you submit.

Setfolios News contains original editorial summaries and reporting supported by linked sources. Articles may be assisted by automated research and drafting tools but require editorial approval before publication. News is informational and is not legal, financial, employment, investment, or professional advice. Third-party names, marks, facts, links, and credited images remain subject to their respective rights.

Do not break the law; infringe privacy, publicity, intellectual-property, or contractual rights; impersonate others; scrape or harvest member data; reverse engineer protected parts of the service; bypass access controls or payment limits; upload malware; disrupt the platform; automate abusive applications or messages; publish fraudulent projects; or use Setfolios to facilitate exploitation, trafficking, harassment, or unsafe work. Setfolios must not be used to recruit for, advertise, produce, distribute, or facilitate pornography; actual or unsimulated sexual activity; sexual services; adult or fetish entertainment intended primarily for sexual gratification; or non-consensual or hidden-camera intimate content. These activities are not allowed on Setfolios.

Project owners must disclose known partial or full adult nudity on every role whose selected creative will be asked to appear nude, before applications or auditions, and must keep the disclosure accurate if the scope changes. A member’s optional setfolio preference, application, invitation, audition, selection, or hiring decision does not constitute consent to any particular nude scene, image, recording, distribution, or use. Project owners and participants are responsible for separately agreeing the precise scope, permitted use, working conditions, age verification, and legally appropriate safeguards. Anyone recruited to appear nude or take part in sexualised content must be 18 or older. The performer’s actual age—not the stated age of a fictional character—governs this age-verification requirement. Casting an adult does not make otherwise unlawful or prohibited content permissible.

Setfolios may investigate reports; limit public visibility; remove content; reject or close projects; suspend or block accounts temporarily or indefinitely; preserve evidence; and permanently remove an account when reasonably necessary to enforce these Terms, protect people, comply with law, prevent harm, or secure the service. Serious or urgent action may be immediate. Where appropriate, members may contact support to request review or restoration.

Setfolios integrates with third-party services and links to external sites. Their terms and privacy practices apply independently. Setfolios is not responsible for third-party availability, content, payment services, portfolio hosts, social networks, publisher sites, or conduct outside the platform, except where the law makes Setfolios responsible.

Setfolios may maintain, secure, update, add, remove, or discontinue features. Reasonable efforts will be made to communicate material changes that adversely affect paid access. The service is provided with the level of care required by applicable law, but uninterrupted or error-free operation cannot be guaranteed.

Setfolios remains responsible for providing its own services with the care and skill required by applicable law. Setfolios is not responsible for the quality, outcome, safety, legality, payment, or performance of work separately agreed between members, or for loss caused by a member's acts or omissions, unless and to the extent the loss was caused by Setfolios' own breach. For members using Setfolios for business purposes, and where the law permits, Setfolios is not liable for indirect or consequential loss, lost profit, revenue, opportunity, goodwill, or data arising from a member-to-member engagement or an external service. Nothing in these Terms excludes or limits liability for fraud or fraudulent misrepresentation, wilful misconduct, death or personal injury caused by negligence where such liability cannot be limited, or any mandatory consumer right or remedy.

You may stop using Setfolios at any time. Members can permanently delete an account through Account Settings after confirming their current password and the irreversible action. Self-service deletion cancels active subscription renewals, archives owned projects, removes the public setfolio and profile media, and anonymises retained shared collaboration records. Billing, tax, safety, moderation, audit, dispute, and legal records may be retained where required or reasonably necessary. A deleted account cannot be restored, although the same email address may be used to create a new account later. Setfolios may terminate access for serious or repeated breach, legal requirements, security risks, or discontinuation of the service. Provisions concerning payments, ownership, licences already exercised, records, disputes, and liability survive where their nature requires it.

These Terms are governed by Spanish law, without limiting mandatory protections available to consumers in their country of residence. Courts determined by applicable law will have jurisdiction. Before filing a claim, users are encouraged to contact Setfolios so the issue can be investigated and, where possible, resolved informally.
